New Ordinance Proposes “Lights out at 11pm”?

A new ordinance proposal which people are calling “Lights Out at 11pm” seeks to establish “performance standards and regulations” on Balboa Peninsula businesses open past 11pm… I think we all can see where this is going.

How on earth can they do this; you ask: They can’t simply cause a business to change their hours, right?
Simple: The proposal will mandate an update (or creation of) an Operators License each time a business needs to amend their Conditional Use Permit or modify their occupancy requirements.

This proposal for the required Operators License is granted at the will of the Chief of Police.  This gives full power of whether or not businesses can stay open past 11pm to a completely unelected position.

Many people may scoff and proclaim “that’ll never happen, it’s been like this forever and it will never change”– however one needs only to look at the dancing ban that Woody’s Wharf has suffered through for the last 2 years to see that things do not always remain the same– nor does council always act in a legal fashion.

Now, the new council has so-far been fantastic, and those illegal, immoral, and unconstitutional actions are all reflective of the old council– but simply ask yourself– why else is this being pushed?

If you have feelings about this requirement on our Balboa businesses, the council will be hearing public comments on it tomorrow.  THIS IS YOUR ONLY CHANCE TO COMMENT BEFORE THE VOTE.  Please show up and let Council know your opinion on this so that they can be sure to vote in favor of the majority.
